RE: The tariff classification of a bra from China

Dear Ms. Mackenzie:

In your letter dated June 17, 2015, you requested a tariff classification ruling. We are returning the sample, as requested.

The sample submitted, style ARDWS16001, “D Bra”, is a bra used for dance. It is constructed from 85% polyester, 15% elastane knit fabric and has a front inner lining constructed from 88% polyester, 12% elastane knit fabric. The highly supportive garment features an approximately 1 inch covered elastic bottom band, a V-front neckline and thin elasticized straps crisscrossing in the front and back.

The applicable subheading for this style will be 6212.10.9020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for brassieres, whether or not knitted or crocheted, brassieres, other, other, of man-made fibers. The rate of duty will be 16.9 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
